A South African court has temporarily paused parliamentary impeachment proceedings against President Cyril Ramaphosa concerning the $580,000 Phala Phala farm scandal. This decision provides the president with temporary legal relief while his challenge to the impeachment process is under review.
The Western Cape High Court’s ruling prevents Parliament from moving forward with public impeachment hearings until a resolution is reached regarding Ramaphosa’s application to review an independent panel report. This report suggested he may have committed serious constitutional violations and misconduct. However, the ruling does not dismiss the impeachment process but only postpones the hearings until the court delivers a final decision.
The controversy arose from the 2020 theft of approximately $580,000 in foreign currency from Ramaphosa’s Phala Phala game farm in Limpopo Province. This money, reportedly hidden in a sofa, was purportedly payment from the sale of buffalo to a Sudanese businessman. The issue gained public attention in 2022 when former State Security Agency Director-General Arthur Fraser accused the president of concealing the theft and mishandling the subsequent investigation. Ramaphosa has maintained his innocence, claiming the money came from a legitimate business transaction and that he acted lawfully.
Opposition parties argue that this scandal poses significant questions about transparency, accountability, and potential constitutional violations. An independent parliamentary panel previously indicated there was enough evidence to suggest the president might have breached his constitutional duties, prompting lawmakers to start an impeachment inquiry under Section 89 of South Africa’s Constitution.
In response, Ramaphosa sought urgent intervention from the Western Cape High Court to halt the impeachment committee’s actions until his legal challenge against the panel’s findings is addressed. His review application is slated for consideration in September, and the court concluded that continuing with the impeachment hearings beforehand could jeopardize the review’s outcome.
Ramaphosa expressed approval of the court’s ruling, underscoring his dedication to legal and constitutional responsibility. Parliament also recognized the decision and stated it would carefully examine the judgment before determining its next steps in the impeachment process.
The Phala Phala affair remains one of the most sensitive political issues during Ramaphosa’s presidency, impacting his anti-corruption reputation despite his denials of wrongdoing.
