The Federal High Court in Abuja has struck out the eight-count criminal charge filed by the Federal Government against Adeniyi Adeyemi, who is accused of presenting himself as the Director-General of the purported Presidential Foreign Intervention Promotion Council (PFIPC).
Justice Mohammed Garba Umar struck out the charge on Monday following an application by the Federal Government to terminate the proceedings and pursue a fresh arraignment before the High Court of the Federal Capital Territory (FCT).
The application was moved by the Director of Public Prosecutions of the Federation, Rotimi Oyedepo, a Senior Advocate of Nigeria (SAN).
Oyedepo told the court that the Attorney-General of the Federation and Minister of Justice had reviewed Adeyemi’s case file and the charge initially filed by the Inspector-General of Police. The review, he said, revealed legal issues requiring the case to be handled by the FCT High Court.
According to the prosecution, the documents Adeyemi allegedly forged while operating the purported agency involved offences that could be prosecuted by the FCT High Court rather than the Federal High Court.
Oyedepo also informed the court that a fresh charge had been filed before the FCT High Court and that the government intended to arraign Adeyemi there without delay.
He subsequently asked Justice Umar to strike out the existing charge to allow the prosecution to proceed in the appropriate court.
Adeyemi’s counsel, Ibrahim Angulu, SAN, did not oppose the application. The judge consequently granted the request and struck out the eight-count charge.
Adeyemi had been facing trial alongside two other defendants identified only as Femi and Anu, whose whereabouts were reported to be unknown. The case involved allegations bordering on conspiracy and forgery.
The latest ruling ends the proceedings on the existing charge before the Federal High Court. It does not amount to a finding of guilt, and the Federal Government says it intends to continue the case through a fresh arraignment at the FCT High Court.
